Fairfax Motorcycle Accident Lawyer

Motorcycle accidents are not like other types of auto accidents. Not only are the injuries usually more severe, but victims often must overcome unfair stereotypes to convince insurance companies and juries. These are very difficult cases. BenGlassLaw can help you get the fair treatment and compensation you deserve.

Motorcycle cases are an uphill battle. But you don’t have to fight it alone

In principle, a motorcycle accident lawsuit should be just like any other type of motor vehicle accident. The principles of fault and liability are the same. The damages you claimโ€”medical bills, lost wages, pain and sufferingโ€”are the same, and calculated the same way.ย ย

But in practice, there’s a world of difference. Motorcycle accident victims are more likely to be severely and permanently injured, and the nature of those injuries can also be different. For example, most motorcycle crash victims have long-term scarring, while most car accident victims won’t.ย

On top of that, insurance companies and juries tend to be especially skeptical when evaluating a motorcycle accident claim. Most bikers are safe, responsible drivers. However, many people hold unfair negative stereotypes about them. Motorcyclists get labeled as risk-takers and thrill seekers. Juries may be less likely to give them the benefit of the doubt when there’s any gray area about who caused the accident.ย ย

In a contributory negligence state like Virginia, you can lose your entire claim if you’re held even 1% at fault. This puts riders in an extremely vulnerable legal position.ย

If you or someone you love is hurt in a Virginia motorcycle accident, you deserve an attorney who understands the motorcycle community, has extensive experience advocating for bikers, will stick by your side, and will fight for what’s rightโ€”even if that means taking the case all the way to court. That’s BenGlassLaw.ย

Why work with our Fairfax motorcycle accident lawyers?

Our team has three main goals for every motorcycle accident case. We will help you:

Find the Money

Multiple insurance policies could apply, including the other driver’s liability insurance, your own uninsured motorist coverage, and others. We’ll find them for you.

Keep the Money

Not only will we extract as much money from those insurance policies as possible, but we’ll negotiate medical bills and liens after the settlement so you can put more money back in your pocket.

Focus on Recovery

Motorcycle accidents are devastating enough without worrying about your legal case. We’ll do the hard legal work so you can focus on health and family.

We also understand that investigating, evaluating, and litigating motorcycle accident claims can be very different from a typical car accident and personal injury claim. There are extra steps we need to take to give you the best chance at a full and fair recovery.ย

BenGlassLaw has extensive experience fighting for motorcycle crash victims and their families. We know how these cases go. We know how to overcome anti-rider bias and tell your story in a way that convinces skeptical insurance companies and juries. And we can give you the honest, objective, and comprehensive advice and guidance you need to make great decisions about your case.ย

Client testimonial

When the insurance company wrongly cancelled my sonโ€™s disability payments, we were scared and desperately needed help. A medical disability is frightening to experience and often overwhelming. It was beyond daunting to think of navigating the denial appeal on our own. A Google search brought up several offices, but it was easy to choose Ben Glass Law after reading their website and โ€œhearingโ€ their understanding and compassion. Damon Miller, Mary Bruniany, and Ben Glass started by truly listening, then demonstrated their understanding as they willingly took on this case. They were knowledgeable, kind, patient, straightforward, fair, and determined. The final 6-page letter that Damon wrote to the insurance company was scathing yet professional as he articulated their many errors and cold responses to a very real and desperate situation and need. Disability funding was reinstated. I think highly of each person at Ben Glass Law who worked with us and of the office team as well. I am forever grateful.

Kelly Merenda

I cannot recommend BenGlassLaw enoughโ€”outstanding is truly an understatement! From the very beginning, the entire team has been exceptional, thoughtful, and highly responsive. They made a complex process feel manageable by consistently keeping me updated and addressing any questions or concerns with impressive speed. I want to express my deepest gratitude to Tammy, whose constant check-ins via emails and texts made managing my case seamless. Her diligence and kindness ensured I never felt out of the loop, which was such a relief. Iโ€™m equally grateful to Lisa, whose incredible knowledge of injury law and its many intricacies gave me complete confidence throughout the process. With Lisaโ€™s expertise guiding the case, I always knew I was in the best possible hands. When the at-fault insurance company initially tried to get away with offering the tiniest settlement imaginable, the BenGlassLaw team stepped in and delivered extraordinary results. Their dedication, professionalism, and care were evident every step of the way. If you need a legal team that combines expertise, compassion, and fast action, look no further. I canโ€™t recommend BenGlassLaw highly enough!

I received an excellent recovery for my car accident. I was struck while riding my bicycle in a bike lane. Thankfully my injuries were not permanent. Melissa and Allie were able to give my case the attention required to compensate me for pain, missed work and medical bills. I would recommend them to anyone.

I can not thank Lisa and Tammy enough! Lisa came highly recommended. She took on Progressive and WON! They even found $75k in extra insurance I didnโ€™t even know I had! Total settlement of $325,000! Frequently Asked Questions

Still have a few questions? If you or someone you love has been injured, the best thing to do is to give us a call and talk with our Virginia motorcycle accident lawyers directly about your case. But if you aren’t sure you’re ready to take that step yet, please feel free to read through our helpful FAQs below.

What are the most common causes of motorcycle accidents?

Most motorcycle crashes are the result of automobile drivers failing to notice the motorcyclistโ€”for example, when turning or changing lanes.ย

It’s not necessarily because the driver forgot to look. Sometimes, people fail to notice things even when they’re in plain sight, simply because they don’t expect to see them in the first place. This is known as inattentional or perceptual blindness, and itโ€™s a frequent contributing factor in auto accidents involving motorcycles, bicycles, and pedestrians.ย

In our experience, the vast majority of motorcycle riders are responsible. They understand how vulnerable they are, and the risks that they’re taking. They ride defensively. Yet because they have an unfair reputation for being thrill-seekers, they might not get the benefit of the doubt from an insurance company or jury.ย

What should I do after a motorcycle accident?

There are certain basic steps you should take in the immediate aftermath of any motor vehicle accident. This includes:ย

  • Reporting the accident to the policeย
  • Swapping information with the other involved driverย
  • Getting contact information from eyewitnessesย
  • Taking photographs of the accident sceneย
  • Seeking medical attention as soon as possible (even if your symptoms seem minor)ย
  • Calling an attorneyย

In the days and weeks that follow, we especially recommend the following for injured motorcyclists:ย

  • Document your injuries. Any attorney will tell you that if it isn’t documented, it didn’t happen. Seek medical attention right away, as those medical records will be absolutely critical for your case. But document on your own as well. Take photos of any road rash or scarring as soon as possible after the wreck. Take more pictures as injuries heal (or don’t heal). Keep a daily pain journal where you talk about your symptoms and how your life has been affected.ย
  • Have a friend or family member observe and document your behavior in the days and weeks following the crash. Traumatic brain injuries are extremely common after motorcycle accidents. Worse, they often go undiagnosed even if you sought emergency care. (ER staff simply are not trained to evaluate TBIs, as they are generally concerned with more urgent or life-threatening issues.) If you show signs such as unpredictable mood swings, memory or concentration problems, disorientation, sleep disturbances, etc., it may be sign of a brain injury.ย

What are the most common motorcycle accident injuries?

Unfortunately, most motorcycle accidents end in severe injury as there is no real protection or framework support on a motorcycle. In fact, rather than protect you in the event of the crash, the motorcycle itself can make injuries worse.ย

Common injuries include:ย

  • Road rashย
  • Burnsย
  • Fracturesย
  • Rotator cuff tearsย
  • Head traumaย
  • Traumatic brain injuriesย

Unlike car accident victims, motorcycle accident victims will almost always have some sort of scarring.ย

If you are the victim of a motorcycle accident, immediately begin documenting all your injuries over the next few months following the accident. You will want to have extensive evidence of the healing process and the pain the injury caused.ย

Do I need a Virginia motorcycle accident attorney?

Because motorcycle crashes usually result in severe injuries with significant medical bills, lost wages, and more, hiring an attorney is almost always in your best interest. Insurance companies don’t hesitate to take advantage of unrepresented crash victims, and an experienced attorney can help you protect your rights.ย

That being said, not every case requires a personal injury lawyer, and not every lawyer is necessarily the right fit for you.ย

BenGlassLaw will never pressure you to hire usโ€ฏif we donโ€™t think we can add value to your claim. We believe in empowering through education. If we donโ€™t think you really need a lawyer, we will direct you to our resources to handle the case yourself (and save you the attorney fees).ย

What should I look for in a Virginia motorcycle accident lawyer?

Most personal injury attorneys follow the โ€œtraditionalโ€ rules of personal injury cases, but not all motorcycle accident attorneys operate the same way.โ€ฏMotorcycle cases have a lot of differences from a typical car accident case, so your choice in attorneys should be based on things like:ย

  • Their experience with motorcycle accidents like yours.ย
  • The reviews and testimonials from their current or former clients (which can usually be found on their website).ย
  • Their ranking on sites like Avvo.com orโ€ฏMartindale-Hubbell.ย
  • Phone interviews with the attorney where you discuss your case.ย

We encourage you to research many attorneys while you look for someone to help with your case.โ€ฏBenGlassLawโ€ฏalso offers articles, webinars, and books that will teach you the basics of accident cases. In fact, attorney Brian Glass has created a motorcycle accident education series on YouTube that we believe can help give you some information about your case.ย

When should I contact an attorney?

The best time to contact an experienced motorcycle accident lawyer is always as soon as possible. The sooner you get honest, objective legal advice, the betterโ€”even if, in the end, you decide not to hire an attorney.ย

Far too often, we see good cases get wrecked because accident victims made preventable mistakes in the first few days and weeks following a wreck. Examples include not seeking medical treatment right away, giving an ill-advised recorded statement to the insurance adjuster, or not documenting injuries soon enough.ย

At BenGlassLaw, we’ll evaluate your case for free, and make sure you start taking the steps you need to take to seek compensation and protect your financial futureโ€”whether you hire us or not.ย

How can BenGlassLaw help me with my motorcycle accident case?

Our lawyers perform aโ€ฏsix-point assessmentโ€ฏof your case to determine whether hiring an attorney makes sense for you.ย

  1. Fault. Virginia is a contributory negligence state. If you are at fault for your motorcycle accident, even 1% at fault, you cannot recover damages. Often, insurance companies use this to reject personal injury claims, even when the victim didnโ€™t contribute to the accident.ย
  2. Current injury. The worse your injury, the more it makes sense to hire a lawyer for your personal injury claims. Motorcycle accident victims with serious injuries, like broken bones or torn ligaments, should consult with an attorney before making any recorded statements with the insurance company.ย
  3. Previous injuries.โ€ฏInsurance companies love to use previous injuries as a reason to deny motorcycle accident claims. They will point to your previous injuries and claim your accident injuries are โ€œpre-existing.โ€ We will review your past medical history to see what impact it might have on your settlement.ย
  4. Treatment. Insurance companies have a โ€œlength of treatment algorithmโ€ that they use to determine how long your treatment should last. If your medical treatment takes longer than the insurance company deems is normal, they will not give you a fair offer for your medical bills.ย
  5. Motorcycle Insurance. โ€œYou canโ€™t get blood from a stone.โ€ We have seen more good cases torpedoed by poor insurance than we can count. Although it is perfectly legal to drive a car without insurance in Virginia, it is illegal to ride an uninsured motorcycle.โ€ฏIf the person who caused your accident is uninsured or underinsured, we will need to look at your policy to see if we can find coverage to pay for your damages.ย
  6. Health Insurance.โ€ฏMany health insurance companies will seek repayment of bills they paid on your behalf. We will make sure they donโ€™t get more than they deserve (which is sometimes zero).ย
